Applying for Probate

Probate is the term given to the process of estate administration after a person dies, by this we mean collecting money, paying off debts and distributing the estate to those people entitled to it.

Applying for probate is needed in order to be able to administer the estate of the deceased.  This is the job of the executor who should be named within the deceased’s Will.

If there was no will left by the deceased a close relative can apply to the Probate Registry to deal with the estate. In this case they apply for a ‘Grant of Letters of Administration’. If the grant is given, the persons appointed to act are known as ‘administrators’ of the estate.

Therefore, ensuring you have a valid and up to date will ensures your wishes are respected and your estate can be distributed in accordance with the law by a person of your choice.

Once a person is in possession of the Grant of Probate they have authority to handle the deceased’s assets (property, savings and investments).

You can use the grant of probate to show you have right to access funds, sort out finances, and collect and share out the deceased person’s assets as set out in the will.

Do I need to apply for Probate?

Yes, organisations holding money in the deceased’s name need to know to whom the money should be paid to.  The grant is their proof that the person named has authority to collect the money.

A grant cannot be provided until any relevant Inheritance Tax (IHT) has been paid on the deceased’s estate.
