A declaration of trust is simply an agreement between two of more people (parties) as to how much each person would be entitled to in the event of a sale of the property.

Making a declaration of trust if often sensible if the parties are unmarried. In recent years it is becoming more and more popular to purchase property as an unmarried couple and indeed many couples may choose never to marry.  A declaration of trust may also be useful if one party contributes a significantly higher amount than the other.

By having such a declaration in place, should you decide to part ways, the agreement clearly spells out what each person is entitled too often relieving what could be additional stress at an already tense time.
