Cohabitation Advice

Solomons Solicitors

Cohabitation is the term given to unmarried or same sex couples who live together. At present there is no law in place tailored to the needs of cohabiting couples and they do not have the same entitlements as divorcing couples if their relationship breaks down. The law does not recognise “common law spouses.”

Perhaps you are considering cohabiting with someone and would like to know the legal implications before doing so. Alternatively you may be already cohabiting or in the process of separating and would like advice on your financial position.

You may be interested in having a Cohabitation Agreement drawn up to clarify the ownership of shared property and other assets. This will protect both you and your partner and will ensure that any children you have are provided for, should anything unexpected happen.
