Pre-nuptial
Agreements
Many couples contemplating marriage or remarriage may want to consider
entering a pre-nuptial agreement. This document sets out to protect the people involved from financial loss
and difficulties if the relationship breaks down at a later stage. The agreement sets out who will own
individual assets. Whilst such agreements do not specifically bind the Court in England and Wales, more
weight is increasingly being attached to them by the Courts and, if a valid pre-nuptial agreement exists
between the parties, its terms will generally be upheld unless the Court considers there is good reason to
