Changing
your Will
It is often put to
the back of peoples mind when a relationship has broken
down, however, it is vitally important to update or
create a new will as soon as possible. It is generally
the case that couples who are separating no longer wish
to leave their property to their former partner, who may
occur under an existing, will or if no will has been made
at all. In addition, after a divorce has been granted,
any previous Will(s) made by you or your previous partner
will be invalid. Making sure that your personal and
financial circumstances are in order is the only way to
ensure that your affairs will be properly looked after,
this is crucially important if you have children and want
to ensure their wellbeing later on in
life.
Pre-nuptial
Agreements
Many couples
contemplating marriage or remarriage may want to consider
entering a pre-nuptial agreement. This document sets out
to protect the people involved from financial loss and
difficulties if the relationship breaks down at a later
stage. The agreement sets out who will own individual
assets. Whilst such agreements do not specifically bind
the Court in England and Wales, more weight is
increasingly being attached to them by the Courts and, if
a valid pre-nuptial agreement exists between the parties,
its terms will generally be upheld unless the Court
considers there is good reason to decide otherwise. We
